WHEREAS, The CO-ORDINATOR manifests and guarantees that he/she possesses the requisite qualities and competencies needed by Mr.MANTHRA OF KREDAS INFRA SOLUTIONS INDIA PVT. LTD. in the conduct and course of its business;
NOW THEREFORE, the COORDINATOR hereby agrees as follows:
1. Employment and Payment
The CO-ORDINATOR agrees that he/she will at all times faithfully, industriously, and to the best of his skill, ability, experience and talents, perform all of the duties required of his position. In carrying out these duties and responsibilities, the COORDINATOR shall comply with all Employer policies, procedures, rules and regulations, both written and oral, as are announced by the Employer from time to time. It is also understood and agreed to by the COORDINATOR that his assignment, duties and responsibilities and reporting arrangements may be changed by the Employer in its sole discretion without causing termination of this agreement.
The COORDINATOR will not get any salaried income. He/She will get the income through the share in the business made by them as long as the Franchisee are with the company recruited by them, the honorary income will be as per the discussions between the company and COORDINATOR during this agreement.
2. Roles and Responsibilities
The COORDINATOR is required to perform the following duties:
He/She should have to recruit the District wise Franchisee and the Area wise Franchisee.
He/She should have to follow-up the franchises recruited by him/her regarding the business regularly.
He/She should have to take the responsibilities encircling the designated post in a professional manner.
3. Tenure
The COORDINATOR under this agreement is bound to serve the Company till the Franchisee i.e., the District wise Franchisee and the Area wise Franchisee which are recruited by him/her are with the company i.e., Mr.MANTHRA OF KREDAS INFRA SOLUTIONS INDIA PVT. LTD.
4. Termination
After confirmation of Malpractice, the Company can terminate the CORDINATOR services by giving 3 months (90 days) written notice to the COORDINATOR or payment of share in the business done by him in lieu thereof. However, the Company may relieve the COORDINATOR at any time during the notice period with or without any compensation other than the payment of share in the business done by him of the remaining period of notice in case of any misconduct or breach of contract.
During probation period the COORDINATOR services can be terminated by the Company by giving 15 days written notice to the COORDINATOR or payment of share in the business done by him in lieu thereof. However, Company may relieve the COORDINATOR at any time during the notice period with or without any compensation other than the payment of share in the business done by him of the remaining period of notice.
Company has the right to terminate the COORDINATOR services without notice or payment of share in the business done by him in lieu thereof, if the COORDINATOR commit any breach of duties and responsibilities under this contract of service or are found guilty of any gross negligence or misconduct which contravenes the express or implied conditions of the service.
In case of resignation / superannuation / cessation of services, the COORDINATOR need to get clearance certificate from the Company/ Concerned Department and submit all the Company belongings to the office to get the full and final settlement and release from the Company.
Any Company belongings given to the COORDINATOR during the tenure of his employment, to be returned to the Company at the time of separation, if it is found in damaged condition, except the normal wear and tear of the goods received, an amount proportionate to the loss to be recovered from the COORDINATOR against the full and final settlement.
5. Non-Competition
It is acknowledged and agreed that following termination of the COORDINATOR employment with Mr.MANTHRA OF KREDAS INFRA SOLUTIONS INDIA PVT. LTD. for any reason the COORDINATOR shall not divulge into any untoward activity which shall affect the goodwill and reputation of the company and the Company reserves its rights to take legal recourse against such action of the COORDINATOR.
6. Entire Agreement
This agreement contains the entire agreement between the parties, superseding in all respects any and all prior oral or written agreements or understandings pertaining to the employment of the COORDINATOR by the Employer and shall be amended or modified only by written instrument signed by both of the parties hereto.
7. Severability
The parties hereto agree that in the event any article or part thereof of this agreement is held to be unenforceable or invalid then said article or part shall be struck and all remaining provision shall remain in full force and effect.
8. Dispute
All dispute(s) shall be subject to the exclusive jurisdiction of the Hyderabad courts only.
The COORDINATOR has set his hand after reading the same as of the date first above written.
